Terms of Service

The Service at theaisound.com (the "Service") is operated by TheAIsound ("we", "us"), a sole trader business trading as theaisound.com. By accessing or using our website and applications, you are entering into an agreement with TheAIsound and agree to be bound by these Terms of Service ("Terms"). If you do not agree, please do not use the Service.

The Service is an AI text-to-speech and audio generation tool: you submit text, and our AI models return generated, studio-styled audio.

You must be at least 18 years old to use this Service. You agree to use the Service only for lawful purposes and in accordance with these Terms. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account, and for providing accurate account information.

Our order process and subscription billing are conducted by our Merchant of Record, Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

By subscribing to our Premium Plan, you agree to pay the recurring monthly or annual fees associated with your chosen plan. All payments are securely processed by Paddle. Payment, billing, tax, cancellation, and refund mechanics are governed by Paddle's Buyer Terms.

You may cancel your subscription at any time through your account settings. Upon cancellation, your premium access will continue until the end of your current paid billing cycle, at which point it will automatically terminate.

You retain all ownership rights to the input text/prompts you provide. To the maximum extent permitted by applicable law, the outputs generated by our AI models (text, audio, or profiles) are yours to use for commercial or personal projects. We claim no ownership over your generated content.

We retain all ownership rights in and to the Service, its software, documentation, branding, and underlying technology. We grant you a limited, non-exclusive, non-transferable right to use the Service within the scope of your selected plan.

The Service uses artificial intelligence to generate audio and related content. Outputs may not always be accurate, error-free, or suitable for your specific purpose. You are responsible for reviewing outputs before using them, especially in regulated or professional contexts.

Prohibited uses include, but are not limited to:

• Creating deceptive, defamatory, harassing, or discriminatory content.
• Generating non-consensual synthetic media, deepfakes, or impersonations.
• Producing malware, spam, or material that promotes illegal activity.
• Jailbreaking, prompt injection, or other attempts to manipulate the model into violating policies.
• Using the Service for any unlawful, fraudulent, or abusive purpose.
• Attempting to interfere with, disrupt, or gain unauthorized access to the Service or its infrastructure.
• Reverse engineering, scraping, or otherwise extracting source code or data except as permitted by law.
• Circumventing usage limits, billing controls, or access restrictions.

You are responsible for the prompts and content you submit, for confirming that you hold all necessary rights to that content, and for how you use the generated outputs. We reserve the right to review, refuse, filter, or remove outputs, and to suspend or terminate accounts for repeated or serious violations.

Rights-holder complaints and takedown

If you believe content generated or distributed through the Service infringes your intellectual property rights or uses your voice or likeness without consent, email support@theaisound.com with a description of the material, the rights you hold, and your contact details. We review complaints promptly, remove or disable access to infringing material, and terminate the accounts of repeat infringers.

We may suspend or terminate your access to the Service at any time if we reasonably believe you have materially breached these Terms, failed to pay applicable fees, posed a security or fraud risk, or engaged in repeated or serious misuse of the Service.

Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination will continue to apply.

The Service is provided on an "as is" and "as available" basis. We do not guarantee that the outputs will be 100% accurate, error-free, or suitable for your specific needs.

In no event shall TheAIsound be liable for any indirect, incidental, or consequential damages resulting from your use of the Service. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose.

Nothing in these Terms limits liability for fraud, death, or personal injury where such limitation is prohibited by law.

You agree to indemnify and hold harmless TheAIsound, its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, liabilities, costs, or expenses arising out of your use of the Service, your content, or your violation of these Terms.

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which TheAIsound is established, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved in the courts of that jurisdiction.

We reserve the right to modify these Terms at any time. Your continued use of the Service after changes are posted constitutes your acceptance of the new Terms.
